The confidentiality of your personal data represents one of the main concerns of REAL TECH SOLUTIONS S.R.L., hereinafter referred to as “RTS”, headquartered in the Republic of Moldova, MD-2005, Chisinau, 59/B Mitropolit G. Bănulescu-Bodoni Street, office 805, acting as data controller.

This document aims to inform you about the processing of your personal data in the context of using the website www.rts.md (hereinafter referred to as the “Website”).

Categories of Personal Data Processed

If you are a visitor of the Website, RTS will process your personal data that you provide directly in the context of using the Website, such as data you provide within the contact / questions / complaints section, to the extent that you contact us in this way.

Purposes and Legal Grounds for Processing

If you are a visitor of the Website, RTS processes your personal data as follows:

1) For marketing activities, namely for transmitting, through means of remote communication (e-mail, SMS, or other alternatives), commercial communications regarding the products and services offered by RTS through the Website.

Legal basis: The processing of your data for this purpose is based on your consent, if you choose to provide it.

To unsubscribe from receiving such commercial communications, you may use the option available at the end of each e-mail/SMS containing commercial communications. Providing your data for this purpose is voluntary. Refusal to provide consent for processing your data for this purpose will not have negative consequences for you.

2) For resolving complaints, claims, and for monitoring traffic and improving your experience offered on the Website.

Legal basis: The processing of your data for this purpose is based on the legitimate interest of RTS in ensuring the proper functioning of the Website, as well as continuously improving the experience of Website visitors, including by resolving various comments, questions, or complaints.

Providing your data for this purpose is voluntary. Refusal to provide data for this purpose will not have negative consequences for you.

Duration of Data Processing

If you withdraw your consent for data processing for marketing purposes, the processing of your personal data for this purpose will cease, without affecting the processing carried out by RTS based on the consent expressed by you prior to its withdrawal.

Disclosure of Personal Data

For the fulfillment of processing purposes, RTS may disclose your data to partners, third parties, or entities that support RTS in carrying out its activity through the Website (for example courier companies, IT service providers), or to central/local public authorities, in the following cases exemplarily listed:

  1. for Website administration;

  2. in situations where such communication would be necessary for awarding prizes or other benefits to data subjects, obtained as a result of their participation in various promotional campaigns organized by RTS through the Website;

  3. for maintaining, personalizing, and improving the Website and the services carried out through it;

  4. for conducting data analysis, testing and research, monitoring usage and activity trends, developing security features and user authentication;

  5. for transmitting marketing commercial communications, within the conditions and limits provided by law;

  6. when the disclosure of personal data is provided by law, etc.

Transfer of Personal Data

Personal data provided to RTS may be transferred outside the Republic of Moldova, but only to countries within the European Union.

Your Rights

Under the conditions provided by the legislation regarding the processing of personal data, as data subjects, you benefit from the following rights:

  1. the right to information, namely the right to receive details regarding the processing activities carried out by RTS, as described in this document;

  2. the right of access to data, namely the right to obtain confirmation from RTS regarding the processing of personal data, as well as details regarding the processing activities such as the manner in which data are processed, the purpose of processing, the recipients or categories of recipients of the data, etc.;

  3. the right to rectification, namely the right to obtain from RTS, without unjustified delay, the correction of inaccurate/unjustified personal data, as well as the completion of incomplete data; rectification/completion will be communicated to each recipient to whom the data have been transmitted, except where this proves impossible or involves disproportionate effort;

  4. the right to erasure of data, without unjustified delay (“the right to be forgotten”), where one of the following grounds applies:

    a. the data are no longer necessary for fulfilling the purposes for which they were collected or processed;

    b. consent is withdrawn and there is no other legal ground for processing;

    c. the data subject objects to the processing and there are no overriding legitimate grounds;

    d. the personal data have been processed unlawfully;

    e. the personal data must be erased for compliance with a legal obligation;

    It is possible that, following a request for erasure, RTS may anonymize such data (thus removing their personal character) and continue processing them for statistical purposes.

  5. the right to restriction of processing where:

    a. the person contests the accuracy of the data, for a period allowing us to verify the correctness of the data;

    b. the processing is unlawful and the data subject opposes the erasure of the personal data, requesting instead the restriction of their use;

    c. the controller no longer needs the personal data for processing purposes, but the data subject requires them for the establishment, exercise, or defense of a legal claim; or

    d. the data subject has objected to the processing (other than direct marketing), for the period during which it is verified whether the legitimate rights of the controller prevail over those of the data subject.

  6. the right to data portability, namely (i) the right to receive personal data in a structured, commonly used, and easily readable format, and (ii) the right for such data to be transmitted by RTS to another data controller, insofar as the conditions provided by law are met;

  7. the right to object – regarding processing activities, it may be exercised by submitting a request as indicated below:

    a. at any time, for reasons related to the particular situation of the data subject, that data concerning them be processed based on the legitimate interest of RTS or on public interest, except where RTS demonstrates compelling legitimate grounds which override the interests, rights, and freedoms of the data subject or where the purpose is the establishment, exercise, or defense of a legal claim;

    b. at any time, free of charge and without any justification, that data concerning them be processed for direct marketing purposes.

  8. the right not to be subject to an individual automated decision, namely the right not to be subject to a decision based solely on automated processing activities, including profiling, which produces legal effects concerning the data subject or similarly significantly affects them;

  9. the right to address the National Center for Personal Data Protection, insofar as you consider it necessary.
